General Terms and Conditions (GTC) and Customer Information
1. Scope
1.1 These General Terms and Conditions (GTC) of Strong Magnets GmbH (hereinafter "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller regarding the goods presented in the Seller's online shop. The validity of the Customer's own terms and conditions is hereby rejected, unless otherwise agreed.
1.2 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.
1.3 An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.
2. Conclusion of contract
2.1 The product descriptions contained in the Seller's online shop do not constitute binding offers by the Seller, but serve to submit a binding offer by the Customer.
2.2 The customer can submit an offer using the order form integrated in the online shop. After placing the desired goods in the virtual shopping cart and completing the electronic ordering process, the customer submits a legally binding contractual offer by clicking the button that completes the ordering process.
2.3 The Seller may accept the Customer’s offer within five days by sending the Customer a written order confirmation or an order confirmation in text form (e.g. e-mail).
2.4 If you select a payment method that is processed via PayPal, the payment will be processed via the payment service provider PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg, subject to the PayPal Terms of Use.
3. Right of withdrawal
3.1 Consumers have a statutory right of withdrawal. The withdrawal period is 14 days from the day on which the customer or a third party designated by him takes possession of the goods.
3.2 To exercise the right of withdrawal, the customer must inform the seller (Strong Magnets GmbH, Goldberger Str. 92, 40822 Mettmann, Germany, info@strong-magnets.eu , Telephone: +49 (0)2104 9539020) by means of a clear declaration (e.g. by e-mail or letter) of the revocation.
3.3 In the event of an effective cancellation, all payments, including delivery costs (except for additional costs due to a delivery method other than the cheapest standard delivery method), will be refunded immediately.
3.4 The customer shall bear the direct costs of returning the goods.
4. Prices and payment terms
4.1 The prices quoted are total prices including statutory VAT.
4.2 The payment options are displayed in the seller’s online shop.
4.3 In the case of advance payment, payment is due immediately after conclusion of the contract, unless another deadline has been agreed.
5. Delivery and shipping conditions
5.1 Delivery takes place within Germany and to the delivery countries specified in the online shop.
5.2 Shipping costs are displayed during the ordering process.
5.3 Self-collection is possible.
6. Warranty and liability for defects
6.1 The statutory warranty rights apply.
6.2 For used goods, the warranty period is one year from delivery.
6.3 The customer is requested to report any transport damage immediately to the delivery agent and to inform the seller.
7. Data protection
7.1 The seller's privacy policy can be viewed at https://strong-magnets.de/pages/datenschutz .
7.2 The customer’s personal data will only be processed for the purpose of contract execution and in accordance with legal requirements.
8. Final provisions
8.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
8.2 The place of jurisdiction for all disputes shall be the registered office of the Seller, provided that the Customer is a merchant, a legal entity under public law or a special fund under public law.
8.3 The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
